Divorce and Separation

Divorce can be applied for by either party, however there has to be substantial grounds for divorce and each party has to be in agreement on the petition before signing. If the criteria cannot be met or the petition agreed or if the judge finds good reason not to allow the application then both parties may have to wait up to two years after separation before they can get a divorce absolute. There are many factors to divorce including custody, financial and future support for the party who is on the lower income.
